Resumen

Act 24/2013, of 26 december, in its article 14.4 for production facilities from renewable sources of energy, high-efficiency cogeneration and residues with specific restorative regime, which at least annually updated values of remuneration in the operation for those technologies whose operating costs depend critically on the price of fuel.

This projection is reflected in article 20 of the Royal Decree 413/2014, of 6 june, which states that at least annually will be reviewed, in accordance with the established regulations, payment to the operation for those facilities to resulting from implementation and whose operating costs depend critically on the price of fuel. It also adds that, as a result of this review cannot be removed or incorporate new types of facilities to the resulting from implementation pay to the operation.

Implementation of that mandate, the order EIT/1345/2015, of 2 july, which establishes the methodology of updating the remuneration in the operation of facilities with specific restorative regime regulates the methodology of updating the remuneration in the operation of facilities with the right to the perception of specific restorative regime. This order provides that the revision will be carried out every six months.

A law to the establishment of the values of remuneration in the operation for the second half of 2020 and the first half of 2021, resulting from the implementation of the order EIT/1345/2015, of 2 july.

Moreover, this order, in compliance with the order TED/260/2021, 18 march, and in view of the applications for maintenance of the parameters established through restorative Order TED/171/2020, of 24 february, submitted to the General directorate of energy and Mines within two months since the entry into force of the order comes to the establishment of new plant type needed to accommodate the facilities subject to these requests.

It has been sent to the national commission on the markets and competition and to report to it by that agency is made of hearing procedure through the Consultative Council of electricity.
