Resumen
In accordance with article 3 of act 24/2013, of 26 december, the electricity Sector, the authorisation of the power generation facilities located in the territorial sea is up to the General state administration (AGE).
The current normative framework so far for the authorization of such facilities is the Royal Decree 1028/2007 of 20 july, which establishes the administrative procedure for the processing of applications for power generation facilities in the territorial sea.
However, over the last decade, the marine wind energy sector has been made in knowledge and experience, and thanks to technological concepts such as floating technology has expanded its geographical scope potential. This has led to a growing interest by the operators to develop projects in the spanish coast.
The third additional provision of the royal Decreto-ley 12/2021, of 24 june, it blocks the procedure provided for in royal decree 1028/2007 of 20 july, until the adoption by the government of a new regulatory framework, except for facilities associated infrastructure for testing, demonstration or validation of prototypes and related new technologies to offshore wind power.
In december 2021 the ministry for the Ecological Transition and the demographic challenge issued the “ road map for the development of offshore wind and the energies of the sea in Spain ”, which establishes a target of installed capacity of offshore wind from 1 to 3 GIGAWATTS (GW) in 2030, as well as the lines of action to achieve it. In particular, it indicated the need to adapt the administrative framework for the authorisation and momentum of investment.
On the other hand, by 2022 pending adoption of the Marine spatial planning (POEM), as a tool of zoning of that, once analysed possible interactions with other uses of the sea, would be reflected the areas most suited to the development of offshore wind - owing to a level of planificación- technical feasibility and the environment.
This context, together with the new european framework and national levels, requires the establishment of a new regulatory framework for the development of offshore wind and the energies of the sea.
