Resumen

The Directive (EU) 2018/2001 of the european parliament and of the council of 11 december 2018, on the promotion of the use of renewable energy sources, introduces a new figure in the energy sector: the communities of renewables, which are legal entities owned by individuals, smes or local authorities located in the vicinity of renewable energy projects and whose ultimate aim is to provide environmental benefits, economic and social rights, rather than financial gains.

Similarly, the directive (EU) 2019/944 of the european parliament and the council of 5 june 2019, on common rules for the internal electricity market and amending Directive 2012/27/eu, introduces another figure, the so-called citizens' communities of energy, which make up a vehicle for citizen participation in aspects relating to access the network of non-discrimination and participation in the electricity markets to manage the assets of a generation that may have partners.

Through this royal decree seeks to mainstream national legal principles governing these communities, thus giving energy partial compliance with the mandate of transposition set in the aforementioned community provisions, and introducing a framework that provides legal certainty, provides for the identification and elimination of barriers and admire the necessary measures for their development.

In accordance with article 26.6 of law 50/1997, of 27 november, the government, as amended by law 40/2015, of 1 october, from The Legal Regime of the public Sector, are hearing and public information of the draft royal decree was done by the figures of the communities of renewable energy and energy communities of citizens.

It has been sent to the national commission on the markets and competition and to report to it by that agency is made of hearing procedure through the Consultative Council of electricity.
